中華人民共和國(guó)計(jì)算機(jī)信息網(wǎng)絡(luò)國(guó)際聯(lián)網(wǎng)管理暫行規(guī)定實(shí)施辦法
Implementation rules for provisional regulations of the administration of international networking of computer information in China
第一條 為了加強(qiáng)對(duì)計(jì)算機(jī)信息網(wǎng)絡(luò)國(guó)際聯(lián)網(wǎng)的管理，保障國(guó)際計(jì)算機(jī)信息交流的健康發(fā)展，根據(jù)《中華人民共和國(guó)計(jì)算機(jī)信息網(wǎng)絡(luò)國(guó)際聯(lián)網(wǎng)管理暫行規(guī)定》（以下簡(jiǎn)稱《暫行規(guī)定》），制定本辦法。
Article 1 In accordance with Provisional Regulations of the Administration of international networking of Computer Information in the People's Republic of China (hereinafter referred to as Provisional Regulations), these Rules are formulated for the purpose of strengthening the administration of the international networking of computer information and ensuring the healthy development of the exchange of international information through computers.
第二條 中華人民共和國(guó)境內(nèi)的計(jì)算機(jī)信息網(wǎng)絡(luò)進(jìn)行國(guó)際聯(lián)網(wǎng),依照本辦法辦理。
Article 2 These Rules shall apply to the connection of computer information networks within the territory of the People's Republic of China with international networks.
第三條 本辦法下列用語(yǔ)的含義是：
Article 3 Following are the definitions of terms used in these Rules:
1.國(guó)際聯(lián)網(wǎng)，是指中華人民共和國(guó)境內(nèi)的計(jì)算機(jī)互聯(lián)網(wǎng)絡(luò)、專業(yè)計(jì)算機(jī)信息網(wǎng)絡(luò)、企業(yè)計(jì)算機(jī)信息網(wǎng)絡(luò),以及其他通過專線進(jìn)行國(guó)際聯(lián)網(wǎng)的計(jì)算機(jī)信息網(wǎng)絡(luò)同外國(guó)的計(jì)算機(jī)信息網(wǎng)絡(luò)相聯(lián)接。
(1) International networking refers to the connection of computer inter- connected networks, specialized computer information networks, corporate computer information networks and other computer information networks linked by special lines within the territory of People's Republic of China with foreign computer information networks.
2.接入網(wǎng)絡(luò)，是指通過接入互聯(lián)網(wǎng)絡(luò)進(jìn)行國(guó)際聯(lián)網(wǎng)的計(jì)算機(jī)信息網(wǎng)絡(luò)；接入網(wǎng)絡(luò)可以是多級(jí)聯(lián)接的網(wǎng)絡(luò)。
(2) Access networks refer to computer information networks which are connected with international networks through interconnected networks. Access networks can be those connected at multi-levels.
3.國(guó)際出入口信道，是指國(guó)際聯(lián)網(wǎng)所使用的物理信道。
(3) International inward and outward channels refer to physical information channels required for international networking.
4.用戶，是指通過接入網(wǎng)絡(luò)進(jìn)行國(guó)際聯(lián)網(wǎng)的個(gè)人、法人和其他組織；個(gè)人用戶是指具有聯(lián)網(wǎng)帳號(hào)的個(gè)人。
(4) Subscribers refer to individuals, legal persons and other organizations which connect their computers or networks with international networks through access networks. Personal subscribers refer to individuals with account numbers for networking.
5.專業(yè)計(jì)算機(jī)信息網(wǎng)絡(luò)，是指為行業(yè)服務(wù)的專用計(jì)算機(jī)信息網(wǎng)絡(luò)。
(5) Specialized computer information networks refer to those operated for the exclusive use of certain sectors.
6.企業(yè)計(jì)算機(jī)信息網(wǎng)絡(luò)，是指企業(yè)內(nèi)部自用的計(jì)算機(jī)信息網(wǎng)絡(luò)。
(6) Corporate computer information networks refer to those operated within enterprises for internal use.
第四條 國(guó)家對(duì)國(guó)際聯(lián)網(wǎng)的建設(shè)布局、資源利用進(jìn)行統(tǒng)籌規(guī)劃。際聯(lián)網(wǎng)采用國(guó)家統(tǒng)一制定的技術(shù)標(biāo)準(zhǔn)、安全標(biāo)準(zhǔn)、資費(fèi)政策，以利于提高服務(wù)質(zhì)量和水平。國(guó)際聯(lián)網(wǎng)實(shí)行分級(jí)管理，即：對(duì)互聯(lián)單位、接入單位、用戶實(shí)行逐級(jí)管理，對(duì)國(guó)際出入口信道統(tǒng)一管理。國(guó)家鼓勵(lì)在國(guó)際聯(lián)網(wǎng)服務(wù)中公平、有序地競(jìng)爭(zhēng)，提倡資源共享，促進(jìn)健康發(fā)展。
Article 4 The State shall develop an overall plan for the layout of international networking and the utilization of various resources. International networking shall adopt technical codes, safety standards and policies on service charges set by the State in a unified form so that the quality of the service can be improved. International networking shall subject itself to the administration by level, that is, interconnected units, access units and subscribers are under the administration by level, and meanwhile international inward and outward channels are subject to the unified administration. The State encourages fair competition in a good order in services related to international networking and advocates resources sharing so as to promote the healthy development of international networking.
第五條 國(guó)務(wù)院信息化工作領(lǐng)導(dǎo)小組辦公室負(fù)責(zé)組織、協(xié)調(diào)有關(guān)部門制定國(guó)際聯(lián)網(wǎng)的安全、經(jīng)營(yíng)、資費(fèi)、服務(wù)等規(guī)定和標(biāo)準(zhǔn)的工作，并對(duì)執(zhí)行情況進(jìn)行檢查監(jiān)督。
Article 5 The office of Leading Group for Information Technology Advancement under the State Council is responsible for organizing and coordinating relevant departments in the formulation of regulations and standards for safety, operations, charges and services related to international networking. The office shall check and supervise the enforcement of those regulations and standards.
第六條 中國(guó)互聯(lián)網(wǎng)絡(luò)信息中心提供互聯(lián)網(wǎng)絡(luò)地址、域名、網(wǎng)絡(luò)資源目錄管理和有關(guān)的信息服務(wù)。
Article 6 China Internet Information Center is responsible for the management of internet addresses, domain names and catalogues of network resources and shall provide relevant information services.
第七條 我國(guó)境內(nèi)的計(jì)算機(jī)信息網(wǎng)絡(luò)直接進(jìn)行國(guó)際聯(lián)網(wǎng)，必須使用郵電部國(guó)家公用電信網(wǎng)提供的國(guó)際出入口信道。
Article 7 Computer information networks within the territory of China, when connected with international networks, must use international inward and outward channels provided by the national public telecommunication network of the Ministry of Posts and Telecommunications.
任何單位和個(gè)人不得自行建立或者使用其他信道進(jìn)行國(guó)際聯(lián)網(wǎng)。
No units and individuals are allowed to set up channels by themselves or use other channels for international networking.
第八條 已經(jīng)建立的中國(guó)公用計(jì)算機(jī)互聯(lián)網(wǎng)、中國(guó)金橋信息網(wǎng)、中國(guó)教育和科研計(jì)算機(jī)網(wǎng)、中國(guó)科學(xué)技術(shù)網(wǎng)等四個(gè)互聯(lián)網(wǎng)絡(luò)，分別由郵電部、電子工業(yè)部、國(guó)家教育委員會(huì)和中國(guó)科學(xué)院管理。
Article 8 China Public Computer Interconnected Network, China Golden Bridge Information Network, China Education and Research Computer Network, China Science and Technology Network are under the administration of Ministry of Posts and Telecommunications, Ministry of Electronic Industry, State Education Commission and Chinese Academy of Sciences respectively.
中國(guó)公用計(jì)算機(jī)互聯(lián)網(wǎng)、中國(guó)金橋信息網(wǎng)為經(jīng)營(yíng)性互聯(lián)網(wǎng)絡(luò)；中國(guó)教育和科研計(jì)算機(jī)網(wǎng)、中國(guó)科學(xué)技術(shù)網(wǎng)為公益性互聯(lián)網(wǎng)絡(luò)。
China Public Computer Interconnected Network and China Golden Bridge Information Network are profit-making networks, while China Education and Research Computer Network and China Science and Technology Network are non-profit-making ones.
經(jīng)營(yíng)性互聯(lián)網(wǎng)絡(luò)應(yīng)當(dāng)享受同等的資費(fèi)政策和技術(shù)支撐條件。
Profit-making networks shall be given equal treatment on service rates and technical support.
公益性互聯(lián)網(wǎng)絡(luò)是指為社會(huì)提供公益服務(wù)的，不以盈利為目的的互聯(lián)網(wǎng)絡(luò)。
Non-profit-making networks refer to those serving the public interest which are not operated for making profits.
公益性互聯(lián)網(wǎng)絡(luò)所使用信道的資費(fèi)應(yīng)當(dāng)享受優(yōu)惠政策。
Charges for the channel utilization of non-profit-making networks shall be collected at a preferential rate.
第九條 新建互聯(lián)網(wǎng)絡(luò)，必須經(jīng)部(委)級(jí)行政主管部門批準(zhǔn)后，向國(guó)務(wù)院信息化工作領(lǐng)導(dǎo)小組提交互聯(lián)單位申請(qǐng)書和互聯(lián)網(wǎng)絡(luò)可行性報(bào)告，由國(guó)務(wù)院信息化工作領(lǐng)導(dǎo)小組審議提出意見并報(bào)國(guó)務(wù)院批準(zhǔn)。
Article 9 With regard to the establishment of new interconnected networks, interconnected units must, after being approved by competent authorities at ministerial level, submit their applications and feasibility reports to Leading Group for Information Technology Advancement under the State Council. After examined by the Leading Group, applications and feasibility reports shall be submitted to the State Council for approval.
互聯(lián)網(wǎng)絡(luò)可行性報(bào)告的主要內(nèi)容應(yīng)當(dāng)包括：網(wǎng)絡(luò)服務(wù)性質(zhì)和范圍、網(wǎng)絡(luò)技術(shù)方案、經(jīng)濟(jì)分析、管理辦法和安全措施等。
Feasibility reports on interconnected networks shall mainly include the nature and scope of networking services, technical programs of networking, economic analyses, management and safety measures, etc.
第十條 接入網(wǎng)絡(luò)必須通過互聯(lián)網(wǎng)絡(luò)進(jìn)行國(guó)際聯(lián)網(wǎng)，不得以其他方式進(jìn)行國(guó)際聯(lián)網(wǎng)。
Article 10 Access networks must be connected with international networks through interconnected networks. International networking conducted in other ways is prohibited.
接入單位必須具備《暫行規(guī)定》第九條規(guī)定的條件，并向互聯(lián)單位主管部門或者主管單位提交接入單位申請(qǐng)書和接入網(wǎng)絡(luò)可行性報(bào)告。
Access units must meet the requirements stipulated in Article 9 of Provisional Regulations. Their applications and feasibility reports on access networks shall be submitted to competent authorities or units charged with the administration of interconnected units.
互聯(lián)單位主管部門或者主管單位應(yīng)當(dāng)在收到接入單位申請(qǐng)書后20個(gè)工作日內(nèi)，將審批意見以書面形式通知申請(qǐng)單位。
The competent authorities or units shall inform applicants of their decision in a written form within 20 working days from the date they receive applications.
接入網(wǎng)絡(luò)可行性報(bào)告的主要內(nèi)容應(yīng)當(dāng)包括：網(wǎng)絡(luò)服務(wù)性質(zhì)和范圍、網(wǎng)絡(luò)技術(shù)方案、經(jīng)濟(jì)分析、管理制度和安全措施等。
Feasibility reports on access networks shall mainly include the nature and scope of networking services, technical program of networking, economic analysis, management and safety measures, etc.
第十一條 對(duì)從事國(guó)際聯(lián)網(wǎng)經(jīng)營(yíng)活動(dòng)的接入單位（以下簡(jiǎn)稱經(jīng)營(yíng)性接入單位）實(shí)行國(guó)際聯(lián)網(wǎng)經(jīng)營(yíng)許可證（以下簡(jiǎn)稱經(jīng)營(yíng)許可證）制度。
Article 11 Access units engaged in profit-making operations concerning international networking (hereinafter referred to as profit-making access units) shall be subject to the administration of the system of international networking business licenses (hereinafter referred to as business licenses).
經(jīng)營(yíng)許可證的格式由國(guó)務(wù)院信息化工作領(lǐng)導(dǎo)小組統(tǒng)一制定。
The pattern of business licenses shall be drawn up by Leading Group for Information Technology Advancement under the State Council in a unified form.
經(jīng)營(yíng)許可證由經(jīng)營(yíng)性互聯(lián)單位主管部門頒發(fā)，報(bào)國(guó)務(wù)院信息化工作領(lǐng)導(dǎo)小組辦公室備案。
Business licenses shall be issued by competent authorities charged with the administration of profit-making interconnected units and shall be reported to Leading Group for Information Technology Advancement under the State Council for the record.
互聯(lián)單位主管部門對(duì)經(jīng)營(yíng)性接入單位實(shí)行年檢制度。
Competent authorities charged with the administration of interconnected units shall carry out the annual examination of profit-making access units.
跨�。▍^(qū)）、市經(jīng)營(yíng)的接入單位應(yīng)當(dāng)向經(jīng)營(yíng)性互聯(lián)單位主管部門申請(qǐng)領(lǐng)取國(guó)際聯(lián)網(wǎng)經(jīng)營(yíng)許可證。
Access units engaged in trans-provincial (or regional, municipal) operations shall apply to competent authorities charged with the administration of profit-making interconnected units for international networking business licenses.
在本�。▍^(qū)）、市內(nèi)經(jīng)營(yíng)的接入單位應(yīng)當(dāng)向經(jīng)營(yíng)性互聯(lián)單位主管部門或者經(jīng)其授權(quán)的省級(jí)主管部門申請(qǐng)領(lǐng)取國(guó)際聯(lián)網(wǎng)經(jīng)營(yíng)許可證。
Access units engaged in business operations within their own provinces (or regions, municipalities) shall apply to competent authorities charged with the administration of profit-making interconnected units or other competent authorities at the provincial level under their authorization for international networking business licenses.
經(jīng)營(yíng)性接入單位憑經(jīng)營(yíng)許可證到國(guó)家工商行政管理機(jī)關(guān)辦理登記注冊(cè)手續(xù)，向提供電信服務(wù)的企業(yè)辦理所需通信線路手續(xù)。
With business licenses issued by competent authorities, profit-making access units shall perform registration procedures with the State administrative departments of industry and commerce and go through formalities with enterprises offering telecommunication services for the connection of telecommunication lines.
提供電信服務(wù)的企業(yè)應(yīng)當(dāng)在30個(gè)工作日內(nèi)為接入單位提供通信線路和相關(guān)服務(wù)。
Those enterprises shall begin to provide telecommunication lines and other related services to access units within 30 working days.
第十二條 個(gè)人、法人和其他組織用戶使用的計(jì)算機(jī)或者計(jì)算機(jī)信息網(wǎng)絡(luò)必須通過接入網(wǎng)絡(luò)進(jìn)行國(guó)際聯(lián)網(wǎng)，不得以其他方式進(jìn)行國(guó)際聯(lián)網(wǎng)。
Article 12 Computers or computer information networks of individuals, legal persons and other institutional subscribers must be connected with international networks through access networks. International networking conducted in other ways is prohibited.
第十三條 用戶向接入單位申請(qǐng)國(guó)際聯(lián)網(wǎng)時(shí)，應(yīng)當(dāng)提供有效身份證明或者其他證明文件，并填寫用戶登記表。
Article 13 When applying to access units for international networking, subscribers shall submit valid identification papers and other supporting document． and fill in subscribers' registration forms.
接入單位應(yīng)當(dāng)在收到用戶申請(qǐng)后5個(gè)工作日內(nèi)，以書面形式答復(fù)用戶。
Access units shall send a written reply to subscribers within 5 working days from the date they receive applications.
第十四條 郵電部根據(jù)《暫行規(guī)定》和本辦法制定國(guó)際聯(lián)網(wǎng)出入口信道管理辦法，報(bào)國(guó)務(wù)院信息化工作領(lǐng)導(dǎo)小組備案。
Article 14 In accordance with Provisional Regulations and these Rules, Ministry of Posts and Telecommunications shall formulate rules on the administration of international networking inward and outward channels which shall be reported to Leading Group for Information Technology Advancement under the State Council for the record.
各互聯(lián)單位主管部門或者主管單位根據(jù)《暫行規(guī)定》和本辦法制定互聯(lián)網(wǎng)絡(luò)管理辦法，報(bào)國(guó)務(wù)院信息化工作領(lǐng)導(dǎo)小組備案。
In accordance with Provisional Regulations and these Rules, competent authorities or units charged with the administration of interconnected units shall formulate rules on the administration of interconnected networks which shall be reported to Leading Group for Information Technology Advancement under the State Council for the record.
第十五條 接入單位申請(qǐng)書、用戶登記表的格式由互聯(lián)單位主管部門按照本辦法的要求統(tǒng)一制定。
Article 15 The pattern of application forms and subscribers' registration forms shall be drawn up by competent authorities charged with the administration of interconnected units in accordance with these Rules.
第十六條 國(guó)際出入口信道提供單位有責(zé)任向互聯(lián)單位提供所需的國(guó)際出入口信道和公平、優(yōu)質(zhì)、安全的服務(wù)，并定期收取信道使用費(fèi)。
Article 16 Suppliers of international inward and outward channels shall be responsible for offering international inward and outward channels as well as fair, excellent and safe services to interconnected units. They may collect charges for the use of channels at regular intervals.
互聯(lián)單位開通或擴(kuò)充國(guó)際出入口信道，應(yīng)當(dāng)?shù)絿?guó)際出入口信道提供單位辦理有關(guān)信道開通或擴(kuò)充手續(xù)，并報(bào)國(guó)務(wù)院信息化工作領(lǐng)導(dǎo)小組辦公室備案。
Interconnected units shall go through relevant formalities with suppliers of international inward and outward channels for the connection or extension of international inward and outward channels which shall be reported to Leading Group for Information Technology Advancement under the State Council for the record.
國(guó)際出入口信道提供單位在接到互聯(lián)單位的申請(qǐng)后，應(yīng)當(dāng)在100個(gè)工作日內(nèi)為互聯(lián)單位開通所需的國(guó)際出入口信道。
Suppliers of international inward and outward channels shall provide channels to interconnected units within 100 working days from the date they receive applications.
國(guó)際出入口信道提供單位與互聯(lián)單位應(yīng)當(dāng)簽定相應(yīng)的協(xié)議，嚴(yán)格履行各自的責(zé)任和義務(wù)。
Suppliers of international inward and outward channels and interconnected units shall sign corresponding agreements and strictly perform their respective duties and commitments.
第十七條 國(guó)際出入口信道提供單位、互聯(lián)單位和接入單位必須建立網(wǎng)絡(luò)管理中心，健全管理制度，做好網(wǎng)絡(luò)信息安全管理工作。
Article 17 Suppliers of international inward and outward channels, interconnected units and access units must set up network management centers, strengthen management systems and improve the safety management of network information.
互聯(lián)單位應(yīng)當(dāng)與接入單位簽訂協(xié)議，加強(qiáng)對(duì)本網(wǎng)絡(luò)和接入網(wǎng)絡(luò)的管理；負(fù)責(zé)接入單位有關(guān)國(guó)際聯(lián)網(wǎng)的技術(shù)培訓(xùn)和管理教育工作；
Interconnected units shall sign agreements with access units so as to strengthen the management of their own networks and access networks; carry out technical training and management education concerning international networking for access units;
為接入單位提供公平、優(yōu)質(zhì)、安全的服務(wù)；按照國(guó)家有關(guān)規(guī)定向接入單位收取聯(lián)網(wǎng)接入費(fèi)用。
provide access units with fair, excellent and safe services; and collect charges for networking from access units in accordance with relevant State regulations.
接入單位應(yīng)當(dāng)服從互聯(lián)單位和上級(jí)接入單位的管理；與下級(jí)接入單位簽定協(xié)議，與用戶簽定用戶守則，加強(qiáng)對(duì)下級(jí)接入單位和用戶的管理；
Access units shall subject themselves to the administration of interconnected units and access units at higher levels; sign agreements with access units at lower levels and make subscription regulations with subscribers so as to strengthen the administration of access units at lower levels and subscribers;
負(fù)責(zé)下級(jí)接入單位和用戶的管理教育、技術(shù)咨詢和培訓(xùn)工作；為下級(jí)接入單位和用戶提供公平、優(yōu)質(zhì)、安全的服務(wù)；按照國(guó)家有關(guān)規(guī)定向下級(jí)接入單位和用戶收取費(fèi)用。
carry out management education, technical consulting and training for access units at lower levels and subscribers; provide access units at lower levels and subscribers with fair, excellent and safe services; and collect charges from access units at lower level and subscribers in accordance with relevant State regulations.
第十八條 用戶應(yīng)當(dāng)服從接入單位的管理，遵守用戶守則；
Article 18 Subscribers shall subject themselves to the administration of access units and observe subscription regulations.
不得擅自進(jìn)入未經(jīng)許可的計(jì)算機(jī)系統(tǒng)，篡改他人信息；
They are forbidden from entering certain computer systems without permission and illegally changing others' information;
不得在網(wǎng)絡(luò)上散發(fā)惡意信息，冒用他人名義發(fā)出信息，侵犯他人隱私；不得制造、傳播計(jì)算機(jī)病毒及從事其它侵犯網(wǎng)絡(luò)和他人合法權(quán)益的活動(dòng)。
distributing malicious information, giving out information in other people's names and violating others' privacy through networks; developing and spreading computer viruses and engaging in other activities in violation of legitimate rights and interests of networks and individuals.
用戶有權(quán)獲得接入單位提供的各項(xiàng)服務(wù)；有義務(wù)交納費(fèi)用。
Subscribers are entitled to receiving services of various kinds from access units and obligated to pay relevant charges.
第十九條 國(guó)際出入口信道提供單位、互聯(lián)單位和接入單位應(yīng)當(dāng)保存與其服務(wù)相關(guān)的所有信息資料；在國(guó)務(wù)院信息化工作領(lǐng)導(dǎo)小組辦公室和有關(guān)主管部門進(jìn)行檢查時(shí)，應(yīng)當(dāng)及時(shí)提供有關(guān)信息資料。
Article 19 Suppliers of international inward and outward channels, interconnected units and access units shall store all the data related to their services. When the office of Leading Group for Information Technology Advancement under the State Council and other competent authorities carry out examinations, they shall forward relevant data in a timely manner.
國(guó)際出入口信道提供單位、互聯(lián)單位每年二月份向國(guó)務(wù)院信息化工作領(lǐng)導(dǎo)小組辦公室提交上一年度有關(guān)網(wǎng)絡(luò)運(yùn)行、業(yè)務(wù)發(fā)展、組織管理的報(bào)告。
In every February, suppliers of international inward and outward channels and interconnected units shall submit reports about their network operation, business development and organizational management in the previous year to the office of Leading Group for Information Technology Advancement under the State Council.
第二十條 互聯(lián)單位、接入單位和用戶應(yīng)當(dāng)遵守國(guó)家有關(guān)法律、行政法規(guī),嚴(yán)格執(zhí)行國(guó)家安全保密制度；
Article 20 Interconnected units, access units and subscribers shall abide by relevant State laws and regulations and strictly observe rules on safety and security.
不得利用國(guó)際聯(lián)網(wǎng)從事危害國(guó)家安全、泄露國(guó)家秘密等違法犯罪活動(dòng)，不得制作、查閱、復(fù)制和傳播妨礙社會(huì)治安和淫穢色情等有害信息；
They are not allowed to engage in activities at the expense of State security and secrets and forbidden from producing, retrieving, duplicating and spreading information that may disrupt public order and contain obscene and pornographic contents.
發(fā)現(xiàn)有害信息應(yīng)當(dāng)及時(shí)向有關(guān)主管部門報(bào)告，并采取有效措施，不得使其擴(kuò)散。
Harmful information, once detected, shall be reported immediately to relevant competent authorities and effective measures shall be taken to prevent it from being spread.
第二十一條 進(jìn)行國(guó)際聯(lián)網(wǎng)的專業(yè)計(jì)算機(jī)信息網(wǎng)絡(luò)不得經(jīng)營(yíng)國(guó)際互聯(lián)網(wǎng)絡(luò)業(yè)務(wù)。
Article 21 Specialized computer information networks which are connected with international networks are not allowed to engage in the business operation of international networking.
企業(yè)計(jì)算機(jī)信息網(wǎng)絡(luò)和其他通過專線進(jìn)行國(guó)際聯(lián)網(wǎng)的計(jì)算機(jī)信息網(wǎng)絡(luò)，只限于內(nèi)部使用。
Corporate computer information networks and other networks which are connected with international networks through special lines shall be operated for internal use only.
負(fù)責(zé)專業(yè)計(jì)算機(jī)信息網(wǎng)絡(luò)、企業(yè)計(jì)算機(jī)信息網(wǎng)絡(luò)和其他通過專線進(jìn)行國(guó)際聯(lián)網(wǎng)的計(jì)算機(jī)信息網(wǎng)絡(luò)運(yùn)行的單位，應(yīng)當(dāng)參照本辦法建立網(wǎng)絡(luò)管理中心，健全管理制度，做好網(wǎng)絡(luò)信息安全管理工作。
Units in charge of the operation of specialized computer information networks, corporate computer information networks and other networks which are connected with international networks through special lines shall set up network operation centers, strengthen management systems and improve the safety management of network information with reference to these Rules.
第二十二條 違反本辦法第七條和第十條第一款規(guī)定的，由公安機(jī)關(guān)責(zé)令停止聯(lián)網(wǎng)，可以并處15000元以下罰款；有違法所得的，沒收違法所得。
Article 22 Those who violate Article 7 and Item 1 of Article 10 of these Rules shall be ordered to terminate their networking activities by public security departments and may be imposed a fine less than RMB 15,000. Unlawful incomes, if made, shall be confiscated.
違反本辦法第十一條規(guī)定的，未領(lǐng)取國(guó)際聯(lián)網(wǎng)經(jīng)營(yíng)許可證從事國(guó)際聯(lián)網(wǎng)經(jīng)營(yíng)活動(dòng)的，由公安機(jī)關(guān)給予警告，限期辦理經(jīng)營(yíng)許可證；在限期內(nèi)不辦理經(jīng)營(yíng)許可證的，責(zé)令停止聯(lián)網(wǎng)；有違法所得的，沒收違法所得。
Those who violate Article 11 of these Rules and engage in the business operation of international networking without business licenses shall be given warning and required by public security departments to secure business licenses within a stated time. Those who do not secure business licenses within the stated time shall be ordered to terminate their networking activities. Unlawful incomes, if made, shall be confiscated.
違反本辦法第十二條規(guī)定的，對(duì)個(gè)人由公安機(jī)關(guān)處5000元以下的罰款；對(duì)法人和其他組織用戶由公安機(jī)關(guān)給予警告，可以并處15000元以下的罰款。
If acting in violation of Article 12 of these Rules, individuals shall be imposed a fine less than RMB 5,000 and legal persons as well as other institutional subscribers shall be given warning and imposed a fine less than RMB 15,000 by public security departments.
違反本辦法第十八條第一款規(guī)定的，由公安機(jī)關(guān)根據(jù)有關(guān)法規(guī)予以處罰。
Those who violate Item 1 of Article 18 of these Rules shall be imposed punishment by public security departments in accordance with relevant laws and regulations.
違反本辦法第二十一條第一款規(guī)定的，由公安機(jī)關(guān)給予警告,可以并處15000元以下的罰款；有違法所得的，沒收違法所得。
Those who violate Item 1 of Article 21 of these Rules shall be given warning and may be imposed a fine less than RMB 15,000 by public security departments. Unlawful incomes, if made, shall be confiscated.
違反本辦法第二十一條第二款規(guī)定的，由公安機(jī)關(guān)給予警告，可以并處15000元以下的罰款；有違法所得的，沒收違法所得。
Those who violate Item 2 of Article 21 of these Rules shall be given warning and may be imposed a fine less than RMB 15,000 by public security departments. Unlawful incomes, if made, shall be confiscated.
第二十三條 違反《暫行規(guī)定》及本辦法，同時(shí)觸犯其他有關(guān)法律、行政法規(guī)的，依照有關(guān)法律、行政法規(guī)的規(guī)定予以處罰；構(gòu)成犯罪的，依法追究刑事責(zé)任。
Article 23 Those who violate Provisional Regulations, these Rules and other relevant laws and regulations at the same time shall be imposed punishment in accordance with relevant laws and regulations. They shall be prosecuted for criminal liabilities according to the law for any crimes committed.
第二十四條 與香港特別行政區(qū)和臺(tái)灣、澳門地區(qū)的計(jì)算機(jī)信息網(wǎng)絡(luò)的聯(lián)網(wǎng)，參照本辦法執(zhí)行。
Article 24 These Rules shall also apply to computer networking with Hong Kong Special Administrative Region, Taiwan and Macao.
第二十五條 本辦法自頒布之日起施行。
Article 25 These Rules shall go into effect as of the date of promulgation.
